DUI
The following cases of Driving Under the Influence and the resolution of those cases are found in LaRue District Court: ADE is an abbreviation for Alcohol Driver Education, KAPS stands for Kentucky Alternative Program. A service fee is added to all DUIs and court costs are added to all charges. Birth year is in parenthesis.
Tracy J. Thomas (1971), operating a motor vehicle while under the influence of alcohol or drugs, guilty; failure to produce insurance card, amended; failure of owner to maintain required insurance, guilty; failure to notify address change, dismissed. Operator license suspended 12 months, fined $1,423. Sentenced to 14 days for DUI, 90 days, suspended for failure to maintain insurance, probated for two years. Charged Dec. 4, 2011, disposed Feb. 15.
James P. Newton (1955), operating a motor vehicle while under the influence of alcohol or drugs, amended down; reckless driving, guilty; possession of open alcoholic beverage container in motor vehicle, merged; failure of owner to maintain required insurance, guilty; no or expired registration receipt, dismissed. Fined $743, sentenced to 90 days, suspended. Charged Dec. 22, 2011, disposed Feb. 15.
James A. Butler (1985), operating a motor vehicle while under the influence of alcohol or drugs, guilty; speeding 26 miles per hour over limit, guilty; reckless driving, merged; failure to wear seatbelt, guilty; possession of open alcoholic beverage container in motor vehicle, merged; no operator license, guilty; driving on DUI suspended license, amended. Sentenced to 14 days, six suspended, to serve eight days. Operator license suspended; fined $1,179, cost waived, to pay DUI service fee of $375 only. Charged March 2, disposed March 7.
Jacquelyn Burckley (1968), operating a motor vehicle while under the influence of alcohol or drugs, guilty; possession of open alcoholic beverage container in motor vehicle, guilty; failure of owner to maintain required insurance, guilty. Operator license suspended 90 days, ADE, KAPS, sentenced to four days. Fined $1,021. Charged Jan. 22, disposed Feb. 29.
Heather K. Sparkman (1979), driving on DUI suspended license, guilty; operating a motor vehicle while under the influence of alcohol or drug, second offense, guilty; possession of marijuana, guilty; and use or possession or drug paraphernalia, guilty. Fined $1,533, costs waived, DUI service fee of $375 due; sentenced to seven days on DUI; sentenced to 10 days, suspended, two years probation, on other charges. Charged Aug. 8, 2011, disposed Feb. 15.
Daniel E. Lowe (1991), operating a motor vehicle while under the influence of alcohol or drugs, guilty; displaying altered or illegal license plate, guilty; no or expired registration plate, dismissed; failure of owner to maintain required insurance, dismissed. Sentenced to two days, credit for one day served; fined $798; 90 days ADE, KAPS. Charged Jan. 29, disposed April 4.
Dwight E. Gelhaus (1957), operating a motor vehicle while under the influence of alcohol or drugs, aggravator, guilty; failure to or improper signal, guilty; possession of open alcholic beverage container in motor vehicle, merged. Fined $763, costs and fees waived. DUI service fee not waived. Sentenced to four days. Charged March 9, disposed March 28.
Jason Renville (1983), possession of open alcoholic beverage container in motor vehicle, merged; operating a motor vehicle while under the influence of alcohol or drugs, aggravator, guilty. Sentenced to four days, credit for one day served; 90 days ADE, KAPS. Fined $773. Charged March 21, disposed April 4.
