A New Haven man who was arrested and charged with first-degree rape and second-degree escape last month was indicted on those charges and his arraignment set for Dec. 20 in Nelson Circuit Court.
Matthew Cody Losey, 19, of New Haven, was reportedly at a North Aspen Street residence where the victim accused Losey of rape shortly after midnight Nov. 20, according to a Bardstown Police Department press release.
A witness caught Losey in the sexual act, police said.
Losey was arrested and placed in a Bardstown Police cruiser during the initial investigation. Losey had been vomiting, so officers were forced to leave him unrestrained because of the possibility of asphyxiation while handcuffed.
Police also left the door ajar so he would not vomit in the cruiser.
Losey then escaped from the cruiser and fled on foot, but was eventually apprehended.
